The Ten-Year Lease Taboo: Can Land Lease Terms Align with the Needs of the I&T Industry?

The origin of the standard 10-year lease clause was to prevent landlords and tenants from bypassing property transfer regulations through long-term leases with lower stamp duty, while also clarifying legal rights and obligations. Although Innovation and Technology (I&T) is a strategic priority supported by both the HKSAR and Central governments, land lease frameworks remain tethered to the 'maximum 10-year term' constraint. This is fundamentally misaligned with the life cycle of the biopharmaceutical industry, where the journey from R&D and clinical trials to registration and mass production often exceeds a decade.
